The Globus Pluscard terms and conditions for corporate customers

Purpose

Magazine zum Globus AG ("Issuer") will provide you with a Globus Pluscard ("Pluscard") free of charge (no annual fee) to enable you to make cashless purchases in its shops. This card agreement is concluded between you and Magazine zum Globus. The following agreements are made:

Membership of the SAVOIR VIVRE Club

Every Globus customer with a Globus Pluscard automatically joins the association as a member free of charge.SAVOIR VIVRE Club with. The SAVOIR VIVRE Club aims to promote and support non-profit and charitable endeavours, particularly in the areas of fashion, living, food and beauty, but also in the social field.

Pluscard additional cards

You can order additional cards with your personal Pluscard number for persons working in the same company. As the principal cardholder, you are also liable without limitation for all obligations arising from the use of the additional card. You are obliged to ensure that the additional cardholder complies with these contractual provisions.

Card use and authorisation

The card authorises you to pay for goods and services at the acceptance points connected to the Globus Pluscard system. The card transactions and the resulting claims are deemed to have been authorised by you: a) when you sign the sales receipt or b) without using the card by stating your name, card number and expiry date (e.g. for distance transactions such as telephone, correspondence and Internet purchases).

Credit limit

The maximum credit limit for the Pluscard with payment function is CHF 10,000 (including any additional cards). You will be informed of your individual credit limit in writing when you receive your copy of the contract after a successful credit check. Any adjustment of the credit limit (due to changed financial circumstances) by the issuer is possible at any time and will also be communicated to you in writing. Without your written counter-report within 10 days, the communicated limit is deemed to be recognised by you. It is possible to exceed this limit in the short term if the outstanding amount is reduced again accordingly after receipt of the next statement. You are obliged to use the Pluscard only to the extent that you are able to pay the outstanding amounts on time.

Billing

The monthly (collective) statement from Magazine zum Globus AG contains the receivables for the purchases of goods and services made from all publishers contractually associated with you. The monthly statement does not give rise to a new claim (no novating effect). Statements that are not objected to within 4 weeks of the date of issue are deemed to have been recognised by you.

Payment obligation and conditions

You undertake to pay all claims resulting from card transactions plus any interest and fees. The latter can be found in the fee table and may be adjusted by the issuer at any time, in particular in the event of a change in the cost structure, which will be communicated to you in a suitable form (e.g. statement).

The statements are due for payment upon receipt. You owe an annual interest rate of 12% (0,94% per month) on all transaction amounts from the statement date until full payment. The Issuer may change the annual interest rate at any time, in particular if the maximum interest rate is adjusted pursuant to Art. 1 VKKG. You will be notified of any changes in a suitable form (e.g. statement). You are free to choose between two payment options: a) Settlement of the full amount owed by the end of the month in which the statement was issued. In this case, the interest for the transactions in this billing month will be waived.

b) Monthly payment of at least 10% of the last billing amount (rounded up to CHF 10) by the end of the current month. If the billing amount is less than CHF 500, the minimum payment is CHF 50. Partial payments are considered to be in arrears without a reminder if the payments are not made as agreed. In this case, in addition to interest, you will also owe reminder fees in accordance with the fee table as well as compensation for all other expenses and costs incurred in connection with the collection of the overdue receivables.

Address changes

Changes of name and/or address must be notified to Globus Service, Schweizergasse 12, CH - 8001 Zurich, within 14 days. Until the new address is notified, notifications sent to the last known address will be deemed to have been validly delivered. If a new address is not notified, you will be charged the costs for an address search in accordance with the fee table.

Liability and loss of the Pluscard

Report any loss, theft or misuse of your Pluscard immediately by telephone on 031 511 66 00. Outside office hours, the report should be made to the Globus branch in Zurich, Bahnhofstrasse, tel. 058 578 14 71. A fee will be charged for each replacement card in accordance with the separate fee table. You are fully liable for any use of your Pluscard until you report the loss.

Period of validity and use of your Pluscard

The Pluscard may have an expiry date. If this is the case, it is valid until the end of the date stamped on the card and is automatically renewed. The new Pluscard must be signed immediately upon receipt, the old one must be destroyed immediately. Each Pluscard is personal, non-transferable and only valid with your signature. The Pluscard remains the property of the issuer at all times and can be reclaimed without giving reasons.

Handling data

You agree that the Issuer may process historical and future data about you (e.g. name, address, date of birth, gender, email address, telephone number) as well as data about your activities (e.g. information about payment and order history or with reference to visits to our website). The data is used for the purpose of providing the requested services and developing better services, for the provision and sale of goods, for identity and credit checks, for risk management, for marketing and internal statistics and for analysis purposes. The Issuer may forward the data to other Migros Group companies, which may also use it for the purposes described here. You authorise the Issuer to report the card contract, including the outstanding amount, to the ZEK in the event of card blocking, qualified payment arrears or misuse of the card. The ZEK is authorised to make this data available to other members of the ZEK.

Commissioning of third parties

The Issuers are authorised to commission third parties in whole or in part to process all services arising from the contractual relationship. They authorise the Issuers to provide these service providers with the data required to fulfil the assigned tasks. The service providers are contractually obligated to comply with the Swiss level of data protection.

Contract cancellation, card blocking

This agreement can be cancelled by either party at any time without notice and without giving reasons. Cancellation of the card agreement between you and Magazine zum Globus AG will result in all outstanding amounts becoming due for payment immediately upon receipt of the statement. If the main card is cancelled, any additional cards shall also be deemed to have been cancelled. The issuer reserves the right to block, withdraw or restrict the use of the cards at any time without stating reasons.

Applicable law

This contract is subject to Swiss law.
